- Any related web applications, calculators, tools, landing pages, APIs, and software, including but not limited to:

- AC Sizing Calculator (including acsizer.com)

- Any future estimator, planning, or automation tools

(collectively, the “Services”).

Plumber Dominance™ is a DBA of Battle Plan Marketing, LLC, a California limited liability company (“Company,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

By visiting our website, using our SaaS platform, AI agents, workflow automations, calculators, or otherwise engaging with the Services, you acknowledge that you have read, understood, and agreed to these Terms.

If you are using the Services on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

ALL USERS UNDER 18 YEARS OF AGE ARE STRICTLY PROHIBITED FROM USING THE SERVICES.

If you are under 18, you may not access or use our website, software, or tools.

We reserve the right to deny, suspend, or revoke access to the Services at any time, in our sole discretion.

2. Description of Services

Plumber Dominance™ provides AI-driven automation, lead management, appointment scheduling, workflow automations, and related digital marketing systems for service-based businesses.

The Services may include AI Agents, Workflow Automations, and estimation or sizing tools, which are designed to assist with business operations and general planning. The Services do not replace professional judgment, licensed services, or regulatory compliance.

3. Use of the Services

You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.

Prohibited activities include, but are not limited to:

Attempting to disrupt, damage, or gain unauthorized access to the platform

Using AI agents or automations to send spam, misleading, deceptive, or unlawful communications

Using the Services in violation of third-party rights or applicable regulations

Misrepresenting AI-generated communications as human communications where prohibited by law

4. Estimator, Calculator & Planning Tool Disclaimer

Informational Purposes Only

All calculators, estimators, sizing tools, and planning tools provided by the Services are offered for informational and general planning purposes only. All results are estimates, not guarantees.

No Professional Advice

The Services do not provide engineering, HVAC, plumbing, architectural, building code, legal, financial, or professional advice. Outputs are not a substitute for inspections, load calculations, or evaluations performed by licensed professionals.

User Inputs and Assumptions

Results depend entirely on user-provided inputs, assumptions, and third-party data sources. We do not guarantee accuracy, completeness, suitability, or compliance with local codes or regulations.

5. AI Agents & Automation Disclaimer

You acknowledge and agree that:

- AI-generated outputs may be inaccurate, incomplete, delayed, or inappropriate

- AI agents do not provide professional advice

- Automation failures, delays, or logic errors may occur

- External factors or integrations may affect performance

YOU EXPRESSLY WAIVE ANY CLAIMS ARISING FROM AI-GENERATED OUTPUTS OR AUTOMATED ACTIONS.

6. Third-Party Integrations & Data Sources

The Services may integrate with third-party platforms, CRMs, phone systems, email providers, payment processors, APIs, or data providers.

We are not responsible for third-party failures, data accuracy, outages, breaches, pricing changes, or availability.

7. 100% Satisfaction Guarantee & Refund Policy

Plumber Dominance™ offers a 100% satisfaction guarantee for the first 30 days of a new SaaS subscription.

If you cancel within 30 days, subscription fees will be refunded in full.
Usage-based charges are non-refundable, including but not limited to:

- Phone numbers

- Phone calls

- SMS/MMS messaging

- Email delivery

- AI usage or content generation

After the 30-day period, all payments are non-refundable unless explicitly stated otherwise in writing.

8. Standard Messaging Rates & Usage Fees

Certain Services are billed based on usage and are non-refundable, including:

- Phone tracking numbers

- Call forwarding and recording

- SMS/MMS messaging

- Email delivery

- AI-powered voice, chat, and automation usage

Rates may change based on third-party provider pricing.

9. Fees & Payment

Subscriptions are billed on a recurring basis as outlined in your plan.
Failure to pay may result in suspension or termination and possible data loss.

10. Suspension & Termination

We may suspend or terminate your access to the Services for:

- Violations of these Terms

- Non-payment

- Misuse or abuse of the platform

You may cancel at any time, subject to the refund terms above.

11. Sweepstakes & Promotions

Sweepstakes and promotional giveaways are governed by separate Official Rules.

No purchase necessary. Winners may be required to:

- Complete IRS Form W-9

- Participate in onboarding or setup calls

- Allow creation of case studies

- Provide reviews or testimonials

Winners remain responsible for usage-based charges.

12. Data Privacy & Security

We implement reasonable security measures but do not guarantee the Services are free from breaches or unauthorized access. Use is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Plumber Dominance™, Battle Plan Marketing, LLC, and their affiliates from any claims, damages, losses, or expenses arising from:

- Your use of the Services

- Reliance on calculator or AI outputs

- Violations of these Terms or applicable law

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

- TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING 12 MONTHS

- IF NO PAYMENT WAS MADE, LIABILITY IS LIMITED TO $100

By providing your mobile number, you consent to receive SMS messages.

- Message and data rates may apply

- Reply STOP to opt out

- Consent is not a condition of purchase

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California.

All disputes shall be resolved in Riverside County, California, or through binding arbitration under AAA rules.
